What’s the latest on this saga? I want to know so I bake a cake with a file in it for Cr Smith if he gets locked up. 😉
Actually I think the Colac Herald has it wrong. The media response is ambiguous as to who provided the advice, but the likely inference is that the Municipal Association of Victoria legal team advised that Cr Smith contravened section 76 D.
76 D is quoted at the maximum penalties are listed. It is a long bow to stretch to then say it was Cr Russell who said Cr Smith was at risk of five years imprisonment. I doubt any sensible interpretation would expect the breaches to be given the maximum penalty, so the “risk” isn’t there, nor was it ever really implied, except for in Colac Herald’s reporting.
I’d bet that Lyn Russell would probably laugh at the suggestion it could warrant five years imprisonment. Sensationalistic at best
